The petitioner is the holder of a stage carriage permit for a bus operating on the route from Sainthia to Toruliyahat via Amritoband, Indre, and Simuliyahat.

The petitioner approached the Regional Transport Authority seeking diversion of the said route to operate from Sainthia to Toruliyahat via Diwas, Batasour, and Indre. It is the petitioner's case that the said request was rejected by the Authority on September 20, 2023. This rejection forms the subject matter of challenge in the present writ petition. However, the report submitted by the State before this Court today indicates that a joint policy has been adopted by the Regional Transport Authority, Birbhum, in its meeting held on July 25, 2024, which reads as follows: "RTA board has decided that no extension, alteration, variation & curtailment will be considered unless the owner places the bus attaining the age within 05 (five) years at the time of endorsement in the permit".

It is specifically the case of the State that the petitioner's representation dated December 28, 2023, regarding the proposed diversion shall be considered at the next meeting of the Regional Transport Authority, Birbhum, in light of the aforementioned policy decision. In view of the foregoing, I find no justification to keep this writ petition pending. Accordingly, the writ petition is disposed of with a direction to the Regional Transport Authority, Birbhum, to communicate its decision regarding the proposed route diversion, which may be taken in the upcoming meeting of the Board. It is clarified that the Board shall afford the petitioner an opportunity of hearing before arriving at its decision.

With the aforesaid direction, WPA 11874 of 2025 stands disposed of.
