25. 01. 2022 BP Sl. 26 Court No. 17 WPA 12710 of 2021 (Via Video Conference) Supriya Mandal (Minor), represented by her natural guardian Sanjoy Mandal Vs.

The State of West Bengal & Ors.

Mr. Moniruzzaman Mr. Debasish Saha ..for the petitioner.

Mr. Santanu Kumar Mitra ..for WBCHSE.

Learned advocate for the petitioner has submitted that the marks have not been given properly by the West Bengal Council of Higher Secondary Education. Mr. Santanu Kumar Mitra, learned advocate for the West Bengal Council of Higher Secondary Education has taken a fair stand in this regard. After hearing the parties, I pass the following order.

The Deputy Secretary (Examination), the West Bengal Council of Higher Secondary Education, being the respondent no.4, will consider the representation at page 25 of the writ application after giving an opportunity of hearing to the petitioner within a period

of six weeks from the date of communication of this order. After hearing, one reasoned order is required to be passed by two weeks thereafter.

It has been submitted by the learned advocate for the Council that the petitioner should approach the Council through her school and not directly to the Council. Accepting his submission I direct the petitioner to approach the council through the school and not directly to the council.

With the above observation and direction, this writ application is disposed of.
