Ms. Satyam Mukherjee Ms. Sayani Ahmed Mr. Purnendu Sekhar Ghosh ......For the Petitioners Mr. Malay Singh Mr. Pinaki Dhole Ms. Neelam Singh ......For the State The present Pradhan of the Gram Panchayat and the present Upapradhan who was the earlier Pradhan of the Gram Panchayat are present in person. They have intimated this court that there was already a pucca road which was constructed by Rural Infrastructure Development Fund and not by the Panchayat Authroties.

The road was actually constructed in the year 2015. The petitioners have complained that their private property are being encroached by the R. I. D. F. for construction of the road. From some photographs produced before this court it appears that there was actually a pucca road which was constructed some years back as appears from the condition of the road and now the road is being

repaired.

I find that this is civil dispute between the Government and some private plot owners if they are actually affected at all.

Therefore, this court does not entertain this writ application and the writ application is dismissed. However, the petitioners have the liberty to approach before the appropriate court of law, if they are so advised.
