Records of the present revisional application reflects that the execution report in respect of warrants of arrest is pending. Records also reflect that the complaint case No. 562(C) of 2008 is pending for last 15 years.

In case, the accused persons are not appearing and their warrants are kept pending or not being executed by the police authorities, learned Magistrate is directed to proceed with the next stage of the case for the purposes of issuing proclamation. It has also been submitted that the records are missing. Learned Magistrate would take steps so that the records are made available so that the trial of the case can progress. The learned Magistrate in this particular revisional application is directed to take two harsh steps, one for tracing and recovery of records and secondly compelling the appearance of the accused persons. If required, the Superintendent of Police of the District be involved for execution of the warrants of arrest.

With the aforesaid observations, CRR 1858 of 2023 is disposed of.

Pending applications, if any, is consequently disposed of.
