Both the writ petitioner and the respondent/State and its functionaries are represented by their respective learned advocates.

At the time of hearing, learned advocate for the writ petitioner draws attention of this Court to paragraph no. 3 of the instant writ petition. It is submitted on behalf of the writ petitioner that it is the specific case of the writ petitioner that since 1997, the present writ petitioner and her widow mother were residing on a vested land being Plot/Dag No. 470, J.L. No. 65, under Mouza - Dayalpur, admeasuring about 4.44 Satak without any interruption.

It is the further case of the writ petitioner that considering the financial stringency of the present writ petitioner, she has been granted money in Awas Yojana (Gramin), however, she was unable to construct the said house under the said Scheme over such land since no patta was given to the writ petitioner. It is submitted further that from Page No. 22 of the instant writ petition, it would reveal that on

13.05.2025, the writ petitioner made a representation with the respondent no. 3 requesting him to grant patta in respect of the land particulars of which has been mentioned in paragraph no. 3.

It is the further grievance of the writ petitioner that despite receipt of such letter, the respondent no. 3/authority has not taken any action.

Learned advocate appearing on behalf of the respondent/State and its functionaries in his usual fairness submits before this Court that respondent no. 3 may be directed to take an appropriate decision over the representation of the writ petitioner.

Considering the entire materials as placed before this Court and after hearing the learned advocates for the contending parties, this Court while disposing the instant writ petition directs the respondent no. 3 to consider the representation of the writ petitioner as sent to him on 13.05.2025 and as has been annexed at Page No. 22 of the instant writ petition in accordance with law and after giving an opportunity of hearing to the writ petitioner and/or her authorized representative, shall pass a reasoned order soon thereafter and shall communicate the same to the writ petitioner forthwith either by Speed Post or by Special Messenger.

The entire exercise as indicated hereinabove is to be completed by the respondent no. 3 within 30 working days from the date of communication of the server copy of this order.

Liberty is given to the learned advocate on record for the writ petitioner to communicate the server copy of this order to the respondent no. 3/authority. 9.

The respondent no. 3/authority is hereby directed to act on the server copy of this order.

10. With the aforementioned observation, the instant writ petition being WPA 11879 of 2025 is disposed of. 11.

Urgent photostat certified copies of this order, if applied for, be supplied to the parties upon compliance with all the necessary formalities.
