Affidavit-of-service filed in Court today be taken on record.

The petitioner claims interest on delayed payment of terminal benefits. The petitioner superannuated from service of the WBTCL on 31st October, 2015. He received his terminal benefits of Rs.10,28,006/- towards provident fund and gratuity on 04.02.2016 and Rs.2,91,918/- towards leave encashment on 15.02.2016.

The petitioner is entitled to interest for the period from 01.11.2015 to 04.02.2016 at the rate of 6 per cent per annum towards provident fund and gratuity and from 01.11.2015 to 15.02.2016 at the rate of 6 per cent per annum towards leave encashment. Let
the same be paid to the petitioner by the WBTCL within a period of one month from date.

In default of payment as directed above, the rate of interest shall stand increased to 9 per cent per annum.

The writ petition is disposed of.

There will be no order as to costs.
