Petitioner is aggrieved by the fact that the information which was furnished on 08.02.2025 did not yield any result and the petitioner complains that in spite of a civil suit having been initiated being TS No. 155 of 2020 and direction being passed upon the Kultali Police Station no effective steps have been taken and the petitioner has been subjected to sufferings at the behest of the private respondents which makes out cognizable offences. Learned advocate for the State has submitted a report. Report reflects that on the basis of complaint dated 08.02.2025 Kultali PS Case No. 98/25 dated 08.02.2025 was registered for investigation and on completion of investigation

charge sheet has been submitted before the jurisdictional Court. Subsequently, on 17.05.2025 the petitioner's wife namely, Chaya Naskar also lodged a complaint which was registered as Kultali PS Case No. 417/25 dated 17.05.2025 and the police authorities on completion of investigation submitted charge sheet.

Learned advocate appearing for the private respondents submits since a status quo order is existing upon both the parties as such the prayer for cultivating the land may not be considered. However, this is resisted by the learned advocate appearing for the petitioner.

In view of such submissions petitioner would approach the jurisdictional civil court which is already in seisin of the issue and for necessary directions. Having regard to the steps taken by the police authorities in respect of registration of the cases and the subsequent steps, I direct that the police authorities would continue their surveillance and ensure that no breach of the peace and/or tranquility takes place and/or any untoward incident results because of the strained relationship existing between the parties.

With the aforesaid observations WPA 12180 of 2025 is disposed of.

Report so submitted be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
