It is submitted on behalf of the petitioner that he is in custody for more than two years. It is further submitted there is no progress in the matter since the last rejection of bail by this court. Learned advocate appearing for the State opposes the prayer for bail.

We have considered the materials on record prima facie disclosing involvement of the petitioner in dealing with narcotic substance above commercial quantity. His prayer for bail was rejected earlier. Hence, we are not inclined in granting bail to the petitioner. The application for bail is thus rejected.

We are informed date has been fixed for consideration of charge.

Under such circumstances, we direct the trial court to consider the issue of framing of charge on the said date and if it is unable to do so to positively consider the issue of framing charge within one month
