Heard learned counsels for the parties.

Learned counsel for the petitioner submits that the petitioner is in custody for 3 years and 3 months. Trial is in progress. His further detention is not required. He prays for bail.

Learned counsel for the State opposes the prayer. I have considered the material on record. The statement of the son of the petitioner recorded under Section 164 of the Code of Criminal Procedure implicates the petitioner. The petitioner's confessional statement under Section 164 of the Code of Criminal Procedure has been recorded before the learned Magistrate wherein he has admitted his guilt. Other material on record also implicates the petitioner in the alleged crime.

Considering the gravity of the offence and alleged involvement of the petitioner therein, prayer for bail is rejected at this stage.

The learned trial Court is directed to expedite the trial without granting any unnecessary adjournment to either of the parties, in accordance with law.

The application for bail is thus disposed of. Case diary be returned.
