C.R.M. (M) 655 of 2025 In Re : An Application under Section 439 of the Code of Criminal Procedure/under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Lalgola Police Station Case No.
352/2023 dated 19.08.2023 under Sections 341/323/324/325/308/34 with added Section 304 of the Indian Penal Code.
And In Re : Kajal Sk Mr. Debapriya Samanta Mr. Suhotro Palit Mr. Akash Kr. Chakraborty Ms. Riya Saha ... For the Petitioner.
Mr. Prasun Kr. Datta Ms. Sudeshna Das ... For the State The petitioner is in custody for more than 100 days. Learned counsel for the petitioner submits that the petitioner is similarly circumstanced with the other coaccused who have been granted bail by this Court. Learned counsel for the State opposes the prayer. I have considered the material on record.
It appears from the statement of most of the eye witnesses recorded under Section 161 of the Code of Criminal Procedure that the petitioner is the principal assailant who assaulted the victim with an iron rod on her head. She succumbed to her injuries. Offending weapon was recovered from the house of the petitioner pursuant to the leading statement of the co-accused.
Considering the gravity of the offence and prima facie involvement of the petitioner therein, prayer for bail is rejected at this stage.
The application for bail is disposed of.
Case diary be returned.
Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
