Learned appellate court while disposing of the Criminal Appeal No. 67 of 2023 by its judgement and order dated 10.04.2024 directed the learned trial court to hear the application under Section 23 of the Protection of Women from Domestic Violence Act afresh.

In view of the order passed by the learned appellate court, I am of the view that the petitioner would contest by taking up the issues canvassed in the revisional application before the learned Magistrate at the time of hearing after the case being remanded back to the learned Magistrate in connection with AC Case No. 548 of 2021.

With the aforesaid observations, the revisional application being CRR 1925 of 2024 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
