The petitioner is a disabled son of late Baidyanath Sadhukhan, an assistant teacher of Bolundi Primary School. The petitioner is receiving disabled pension from 1st May, 2023 on account of the service of his father. In addition thereto, the petitioner was already receiving Rs.1,000/- per month for disabled allowance from the State. The petitioner claims that he was entitled to pension from the date of death of his mother i.e. 18th July, 2018.

In these circumstances, let arrear pension for the period from 19th July, 2018 till 30th April, 2023 be paid to the petitioner deducting the monthly disability allowance of Rs.1,000/- per month for the said period within a period of two months from the date of communication of a copy of this order. The arrears, however, shall carry no interest since the petitioner applied for the first time for the same in March, 2024.

With the aforesaid observations, the writ petition is disposed of.

There shall be no order as to costs.
