1. Affidavit of service filed on behalf of the petitioner is taken on record.

2. Grievance of the petitioner is teachers who are junior to the petitioner are getting pay at higher rate and prayer is made for bringing pay parity which would make the petitioner being eligible to get pay at the rate which is not lesser than the pay of junior primary teachers.

3. It is submitted on behalf of District Primary School Council, Murshidabad that there is no anomaly regarding sanctioning 18 years benefit but if it is permissible re-fixation of pay can be made in order to maintain pay parity considering the higher pay of junior teachers.

4. It is also submitted that long back issue was referred to the Director of School Education but there was no response.

5. Having considered the issue involved in this writ petition leave is granted to the petitioner to make a representation to the District Inspector of Schools (PE) Murshidabad within a period of fortnight from date. If such representation is made within the aforesaid time District Inspector of Schools (PE) Murshidabad shall pass a reasoned order on the representation of the petitioner within a period of 8 (eight) weeks after granting opportunity of hearing to the petitioner and a representative of the District Primary School Council, Murshidabad. The reasoned order to be passed by the District Inspector of Schools (PE) Murshidabad shall be communicated to the parties by 10 days thereafter.

6. Writ petition stands disposed of.

7. Leave is granted to the learned advocate representing the petitioner to add District Inspector of Schools (PE) Murshidabad as additional respondent in course of this day.

Service of notice upon the additional respondent is dispensed with since State respondents are represented by learned advocate.

8. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
