Mr. Ganguly, learned advocate for the State submits the memorandum of evidence and a photocopy of the charge-sheet which reflect that the charge-sheet has been submitted in the year 2002 under Section 406 IPC. The case has already been fixed for framing of charge but on different pretext the petitioners are stretching the time.

The report of the concerned Lake Town Police Station reflects that another revisional application being CRR 2441 of 2019 is pending. The report so submitted be kept with the record.

The petitioners have taken up the plea that they have paid the amount. Payment in respect of the amount does not exonerate an accused from the charges, it is only a mitigating circumstance at the time of sentencing.

The petitioners would be at liberty to canvass the points at the relevant stage of the proceedings before the learned trial court.

No interference is called for in the present proceedings.

With the aforesaid observations, CRR 1625 of 2021 is disposed of.

Pending application, if any, is consequently disposed of.
