W.P.A. 12205 of 2025 Priya Singh.

VS The State of West Bengal & Ors.

Mr. Partha Pratim Roy, Mr. Samrat Chakraborty.

...for the Petitioner.

Mr. Amitabha Shah.

...for private respondents.

Mr. Swapan Banerjee, Ld. AGP, Mr. Diptendu Narayan, Mr. Soumen Chatterjee.

...for State.

Affidavit-of-service filed by the petitioner be kept 25.06.2025 Court No. 35 Item No. 70.

Rakib with the record.

The subject matter of the present case is that the present petitioner married one Pankaj Rajak. According to the petitioner the said marriage was not accepted by the parents. Consequently, the petitioner apprehended that torture would be inflicted upon her and her husband. There was a criminal case which was registered and the husband of the petitioner was arrested. However, the petitioner apprehends that she may be subjected to further torture at the behest of the relations including the private respondents.

Learned advocate appearing for the private respondents submits that when the petitioner fled away she was a minor person and presently she is a major and

has no interest of disturbing the marriage of the petitioner.

Mr. Banerjee, learned advocate appearing for the State submits a report. Report reflects that there is a criminal case which was registered for investigation being Dhanwar Police Station case no. 119/2025 dated 15.05.2025. The husband of the petitioner namely, Pankaj Rajak was arrested and was subsequently produced before the jurisdictional Court.

Having regard to the fact that there has been change of circumstances presently, I direct that the police authorities would ensure that neither the petitioner nor the respondent no.5 would disturb each other. In case there is any complaint lodged at the police station, police would cross check the veracity of the correctness before taking any harsh steps against either of the parties. With the aforesaid observations WPA 12205 of 2025 is disposed of.

Report so submitted by the State be kept with the record.

Copy of the report be handed over to both the parties.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
