No. 29 KAUSHIK REJECTED C.R.M.(A) 2091 of 2023 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Berhampore Police Station Case No. 216 of 2023 dated 22.02.2023 under Sections 447/325/308/354/34 of the Indian Penal Code.

The injured in her statement recorded under Section 161 of the Code of Criminal Procedure (Cr.P.C.) states that, the petitioners were found teasing the sister of the injured. The injured intervened and protested whereupon the petitioner was assaulted in such a manner that she suffered grievous hurt. Statement of the injured stands corroborated by her injury report as well as 161 Cr.P.C. statements of the neighbours.

Considering the gravity of the offence and the involvement of the petitioners in the incident, we are unable to grant anticipatory bail to the petitioners.

Accordingly, prayer for anticipatory bail of the petitioners is rejected and the application being CRM (A) 2091 of 2023 is dismissed.
