At issue before this Court today is the restoration of a Contempt Application being CPAN 746 of 2018 arising out of the Final Order dated September 18, 2017 in FMA 1345 of 2014 upon recall of the order of dismissal for default dated 7th August, 2019. Affidavit-of-Service filed in Court today be taken on record.

Mr. Vaisya, learned Additional Government Pleader (AGP), appears for the alleged Contemnor Nos. 1 and 2.

Having heard the parties and considering the materials placed, this Court finds that sufficient cause has been pleaded in CAN 9663 of 2019 which persuades this Court to recall the order dated 7th August, 2019.

Furthermore, CAN 9663 of 2019 is filed within time.

Accordingly, CPAN 746 of 2018 is restored to its original file and number.

CAN 9663 of 2019 stands accordingly disposed of.

Let a copy of CPAN 746 of 2018 with its annexures be now served on learned Counsel appearing for the alleged Contemnor Nos. 1 and 2. The parties shall take appropriate instructions and assist this Court on the next date.

Let the Contempt Application next appear under the same heading 'Application' (Group-II) (Contempt) on 30th June, 2022.
