It is not in dispute that both the petitioner and the private respondents are patta holders in respect of the plot in question.

The petitioner is aggrieved by the unauthorized construction raised by the private respondents. The petitioner submitted a representation before the concerned authority on 19th March, 2024 ventilating his grievance and seeks consideration of the same.

It appears from the report submitted by the State that permission for raising construction was accorded to both the parties by the Panchayat authority on 20th April, 2013 pursuant to applications made by the parties. However, the plot number in respect of which such

permission was granted does not match with that of the writ petition.

Be that as it may, since the representation submitted by the petitioner before the concerned authority is pending, the Pradhan, Karanjali Gram Panchayat, being the 6th respondent herein, is directed to consider and dispose of the same within six weeks from the date of communication of this order upon granting reasonable opportunity of hearing to all concerned including the petitioner and the private respondents in accordance with law.

The decision taken by the authority shall be communicated to the parties within a week thereof. The writ petition is accordingly disposed of. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
