06.06.2023 Item No.10 Ct. No.1 RP/gsd WPA (P) 249 of 2023 Hasi Das vs.

State of West Bengal & ors.

Mr. Uday Sankar Chattopadhyay Mr. Suman Sanklar Chatterjee Mr. Rajashree Tah Ms. Trisha Rakshit ... for the petitioners Mr. T. M. Siddiqui Mr. Debasish Ghosh Mr. Prantik Garai ... for the State 1.

This Public Interest Litigation has been filed by a teacher alleging that a decision taken by the School Education Department of the State of West Bengal postponing the Summer Vacation on account of extreme weather condition, is not proper.

2.

In our view, in this matter it is not proper for the Court to interfere as it is for the authority of the Education Department to take assistance of the teachers and other persons to take an informed decision.

3.

If the State feels that the children will be jeopardized, when they are to attend school

on account of heat wave, it is well open to the authority to take a decision.

4.

Thus, we find that no grounds have been made out by the petitioner, who herself is a teacher, to interfere with such decision.

5.

With the above observation, the writ petition is dismissed.
