Petitioner is directed to deposit a sum of Rs,1,50,000/- with the learned Judicial Magistrate, 5th Court, Serampore, Hooghly in connection with Misc. Case No.31 of 2016. The said amount would be retained by the court and would be considered as a part of the amount of Rs.3 lakhs so directed towards compensation. Upon deposit of such amount, the petitioner/husband may be given an opportunity to address on the issues relating to compensation and its entitlement by the wife. So far as the regular maintenance amount is concerned, the petitioner would go on paying the same and the learned Magistrate would in a case for execution exercise his powers under the law.

In the fitness of circumstances, if the husband appears, deposits and prays for hearing of his application limited to the point of compensation amount, the learned Magistrate would dispose of such application within a period of three months.

With the aforesaid observations, CRR 1867 of 2023 is disposed of.
