Learned counsel for the petitioners submits that the petitioners are in custody for 240 days. She submits that two other similarly situated co-accused were granted bail by the coordinate Bench.
Learned counsel for the State draws the attention of the Court to the statement recorded under Section 161 of the Code of Criminal Procedure.
Considering the materials in the case diary and considering the fact that two other co-accused were granted bail by the coordinate Bench and considering the fact that the petitioners are standing on the same footing as that of the coaccused granted bail by the coordinate Bench and considering the fact that the petitioners' standing are different that of the husband of the victim, we grant bail to the petitioners. Accordingly, we direct that the petitioners shall be released on bail upon furnishing a bond of Rs.10,000/- with
two sureties of like amount each, one of whom must be local, to the satisfaction of Additional Sessions Judge, Bishnupur, Bankura, subject to the condition that the petitioners shall appear before the trial court on every date of hearing until further orders and shall not intimidate the witnesses and/or tamper with evidence in any manner whatsoever.
