19.05.2023 Ct. No. 29 KAUSHIK REJECTED C.R.M.(A) 2093 of 2023 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Khanakul Police Station Case No. 316 of 2023 dated 11.05.2023 under Sections 498A/406/304B of the Indian Penal Code and under Section 4 of the Dowry Prohibition Act. And In Re : Sk Saidul Ali @ Sk Saidul Islam & Ors. ...... petitioners Mr. Niladri Sekhar Ghosh Mr. Sourav Mondal ....for the petitioners Mr. S. G. Mukherjee, learned Public Prosecutor Mr. Aniket Mitra Ms. Jonaki Saha ....for the State Leave granted to the learned advocate on record for the petitioner to correct the cause title.

There are statements of neighbours recorded under Section 161 of the Code of criminal Procedure (Cr.P.C.) implicating the petitioners in meting out torture to the victim. According to the neighbours, the torture increased after a daughter was born out of the wedlock. The death occurred within two and half years of marriage. Apparently, the victim committed suicide.

In view of the nature of the materials contained in the case diary, the gravity of the offence and the involvement of the

petitioners in the incident as transpiring therefrom, we are unable to grant anticipatory bail to the petitioners. Accordingly, prayer for anticipatory bail of the petitioners is rejected and the application being CRM (A) 2093 of 2023 is dismissed.
