2025-01-31Hon'Ble Justice Sabyasachi Bhattacharyya2 pages

31st January, (AK) C.O 1706 of 2024 Smt Sujata Pahari and others Vs.

Arvil Dey and others Mr. Triptimoy Talukder Mr. Shamba Chakraborty Mr. Dibyendu Ghosh Mr. Abhiraj Tarafdar ...for the petitioners.

1.

In view of the innocuous nature of the order proposed, no prior service of notice on the opposite parties is deemed necessary.

2.

The petitioners filed a suit for specific performance of a contract for sale in the year 2011.

3.

However, unfortunately, the said suit is still pending.

4.

Apparently, previously a substitution application was pending, which consumed considerable time. 5.

It is submitted by learned counsel for the petitioners that such application has since been disposed of.

6.

Accordingly, there cannot be any impediment in early disposal of the suit, which is already pending for over thirteen years.

7.

I also find from the records that by a previous order dated November 20, 2020, a coordinate Bench had

expressed its opinion that the trial and disposal of the suit may be expedited.

8.

In such view of the matter, C.O. 1706 of 2024 is disposed of by requesting the learned Civil Judge, Senior Division, First Court at Barasat, DistrictNorth 24 Parganas to dispose of Title Suit No.513 of 2011 as expeditiously as possible, preferably within December 31, 2025.

9.

There will be no order as to costs.

10. Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
