Learned advocate for the petitioner submits that the present petitioner being the husband complained regarding the atrocities of the wife and her associates with the police station as well as the office of the superintendent of police and to that effect a general diary has been lodged. It is submitted that in spite of the same the police authorities have registered a case on the basis of a complaint on the wife under Sections 498A/406 IPC against him. The documents which have been relied upon by the petitioner are given to authorities. The probative value of those documents is to be gone into at the appropriate stage.
Petitioner would be at liberty to bring the contents of those documents to the knowledge of the investigating officer of the case. The said documents obviously cannot be the foundation of interference by way of invoking the provisions under Section 482 of Cr.P.C.
Petitioner would also be at liberty to approach this Court in case the investigating agency arrives at a conclusion by submitting their reports under Section 173 Cr.P.C. and the petitioners thereafter are served copies under Section 207 Cr.P.C.
With the aforesaid observations, CRR 1869 of 2023 is disposed of.
