Heard the parties.

The grievance of the petitioner is directed against the failure on the part of the respondent authorities to dispose of the proceeding initiated under the Payment of Gratuity Act, 1972.

It is alleged on behalf of the petitioner that though this proceeding was initiated as far back as on October 26, 2018, no steps have been taken by the respondent No.2 to dispose of the case.

In view of the submission of the parties, I direct that the respondent No.2 to consider and dispose of the case No.100/18/G/HOW (Ramchandra Roy vs. Delta Ltd.) within a period of 8 weeks from the date of communication of this order after giving a right of hearing

to all the affected parties and without giving any adjournment to any of the parties on any ground whatsoever.

The respondent No.2 is at liberty to decide on the mode of hearing as to whether it will be virtual or physical in consonance with the prevalent Covid guidelines. With the aforesaid directions, WPA 12814 of 2021 stands disposed of.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
