Nos. 2 & 3 The present criminal proceeding has been initiated based on a complaint filed by opposite party no. 2, which was registered as Bongaon Police Station Case No. 457 of 2026 dated May 29, 2026. By filing this application, the petitioners have sought for quashing of the said FIR. It appears that during pendency of the application, the disputes between the parties have been amicably settled.
Upon consideration of the materials on record, this Court is of the view that the dispute between the parties is essentially private in nature and that a valid compromise has already been arrived at between them. In such circumstances, the continuation of the criminal proceedings would amount to an abuse of the process of law.
Having regard to the principles laid down by the Hon'ble Supreme Court reported at (2012) 10 SCC 303 (Gian Singh v. State of Punjab), this Court is inclined to exercise its inherent jurisdiction to quash the present proceedings in the interest of justice.
Accordingly, G.R. Case No. 1568 of 2026 corresponding to Bongaon Police Station Case No. 457 of 2026 dated 29.05.2026 under Sections 115 (2) / 117 (2)/ 308 (5)/ 318 (4)/ 336 (3)/ 338/ 340 (2)/ 351 (3)/ 61 (2) of the Bharatiya Nyaya Sanhita, 2023, now pending before the Court of the learned Additional Chief Judicial Magistrate at Bongaon, North 24 Parganas, stands quashed in terms of the compromise recoded in CRAN 1/2026. Consequently, CRR 2291 of 2026 along with CRAN 1 of 2026 stands disposed of.
