WPA 12661 of 2026 (Chandana Das Mandal vs. State of West Bengal & Ors.) Ms. Sanchayita De .... For the Petitioner Mr. Madhu Jana Ms. Puja Sonkar .... For the State Affidavit of service filed on behalf of the petitioner is taken on record.

On prayer of the petitioner liberty is granted to correct paragraphs 2, 3 and 10 of the writ petition by replacing the words 'mother of the petitioner' by 'son of the petitioner'.

Heard learned counsels for the parties.

The son of the petitioner was appointed as Nirman Sahayak of Mandalkuli Gram Panchayat. The son of the petitioner died in harness on 15th June, 2023. Despite completing all pension related formalities within due time, pension payment order was issued by the concerned authority on 13th March, 2024. The gratuity amount and arrear pension were disbursed on 6th May, 2024. The petitioner seeks interest on the gratuity amount and arrear pension paid to her due to delay in disbursal of the same.

Upon consideration of the submission made on behalf of the parties and material on record, the Director of Pension, Provident Fund and Group

Insurance, Government of West Bengal and the Treasury Officer, Khatra, being the 3rd and 4th respondents herein, are directed to pay interest to the petitioner at the rate of 8% per annum on the gratuity and arrear pension amount calculated from 16th June, 2023 till the date of actual payment. Such payment shall be made within one month from the date of communication of this order.

The writ petition is accordingly disposed of. There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.
