The petitioner has suffered a decree of eviction in Title Suit No.140 of 2015 and has preferred the connected appeal being Title Appeal No.1 of 2024 which is pending before the learned Additional District Judge at Bongaon, District: 24 Parganas (North).

The appeal court below, by the order impugned dated May 02, 2024, has only deferred the hearing of the application filed by the petitioner for stay of the connected execution case levied to execute the said decree of eviction for consideration of the said application in the presence of the respondent.

This Court does not find any illegality and/or infirmity in the order impugned warranting interference. CO 1710 of 2024 is therefore dismissed without any order as to costs.
