Heard learned counsels for the parties.

The petitioners are the legal heirs of Aloke Bauri who was appointed as Panchayat Karmee of Santore Gram Panchayat and died in harness on 9th January, 2022. Despite completing all pension related formalities within due time, pension payment order was issued by the concerned authority on 24th August, 2023. The gratuity amount and arrear pension were disbursed on 6th October, 2023. The petitioners seek interest on the gratuity amount and arrear pension paid to them due to delay in disbursal of the same.

Upon consideration of the submission made on behalf of the parties and material on record, the Director of Pension, Provident Fund and Group Insurance, Government of West Bengal and the Treasury Officer, Bankura, being the 3rd and 4th respondents herein, are directed to pay interest to the petitioner at the rate of 8% per annum on the gratuity

and arrear pension amount calculated from 10th January, 2022 till the date of actual payment. Such payment shall be made within one month from the date of communication of this order.

The writ petition is accordingly disposed of. There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.
