Petitioner prays for anticipatory bail.

Learned Advocate appearing for the petitioner submits that one of the co-accuseds was enlarged on bail. The police filed charge sheet and, therefore, custodial interrogation of the petitioner is not required.

Learned Advocate appearing for the State refers to the materials in the case diary. He submits that the petitioner is the principal person who instigated the murder. He refers to the statements of eye-witnesses recorded under Section 161 of the Code of Criminal Procedure.

Considering the gravity of the offence and the involvement of the petitioner therein as transpiring from the materials in the case diary, we are unable to enlarge the petitioner on anticipatory bail.

Accordingly, the prayer for anticipatory bail of the petitioner is rejected.

C.R.M. (A) 2986 of 2022 is dismissed.
