Appeal is at the behest of CESC Limited and directed against the order dated May 20, 2025 passed by the learned Single Judge in WPA 8443 of 2025.

Learned Senior Advocate appearing for the appellant submits that, the learned Single Judge erred in directing the appellant to reconnect electricity supply upon deposit of 50 per cent of the assessed amount.

Learned Advocate appearing for the writ petitioner/private respondent submits, on instructions, that, his client will file an appeal directed against the order of assessment without insisting upon any reconnection. Therefore, his client is not minded to deposit any amount for the

purpose of the appeal.

In view of such stand being taken by the writ petitioner/private respondent in the present appeal, in the facts and circumstances of the present case, it would be appropriate to set aside the order impugned to the extent that it directs the appellant before us to reconnect electricity supply to the writ petitioner/ private respondent upon deposit the specified amount.

This order is passed since the writ petitioner/private respondent himself is not willing to obtain electricity supply.

MAT 808 of 2025 and IA No.: CAN 1 of 2025 are disposed of without any order as to costs.
