For the State The petitioner complains that public land has been encroached upon by the private respondents, thereby causing obstruction to his ingress and egress.

The petitioner applied for redressal before the Executive Officer, Purba Medinipur Zilla Parishad, Ganapatinagar (Nimtouri)on 18th July, 2021, but such application has not been considered till date.

The State submits that the respondent No. 5 is the competent authority to deal with the application under Section 3 of the West Bengal Public Land (Eviction of Unauthorised Occupants) Act, 1962.

Having considered the submissions made on behalf of the parties and material on record, I dispose of the writ petition being W.P.A. 12867 of 2021 with a direction upon

the respondent No. 5 to consider and dispose of the application filed by the petitioner on 18th July, 2021 within a period of three months from the date of communication of this order after giving an opportunity of hearing to all the affected parties including the petitioner ,in accordance with law.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
