Heard learned counsels for the parties.

Learned counsel for the petitioner submits that the petitioner is in custody for about 75 days. Charge sheet has been submitted. The incident is a fallout of an altercation between the petitioner and the victim and occurred at the spur of the moment. There was no premeditation on the part of the petitioner to murder the victim. He prays for bail. Learned counsels for the State and the de facto complainant oppose the prayer.

I have considered the material on record. Eye witnesses have implicated the petitioner in the alleged offence. The post mortem report of the victim supports the prosecution case.

Considering the gravity of the offence and prima facie involvement of the petitioner therein, prayer for bail is rejected at this stage.

The application for bail is thus disposed of. Case diary be returned.
