Mr. Allen Felix ..... for the petitioner Mr. N.C.Bihani .... for the University The petitioner is a student of Political Science in the Burdwan University. The petitioner failed in the first semester in the year 2019, but she cleared 2nd, 3rd and 4th semesters subsequently. The petitioner wanted to sit for the first semester examination along with her final semester examination which was not allowed by the University. The petitioner requested the Controller of Examination, Burdwan University by her representation dated June 17, 2022 to allow her to take the first semester examination along with the final semester. The petitioner submits that her representation has not yet been considered by the Controller of Examination.

Mr. Bihani, learned advocate representing the University submits that as per University Regulations

the petitioner cannot be permitted to sit in the first semester examination along with the final year sixth semester examination since as per the University Regulations, she ought to have taken the first semester examination within three consecutive chances. The petitioner did not avail the said chances.

I, however, feel that the University should consider the representation dated June 17, 2022 addressed to the Controller of Examination in accordance with the relevant provisions.

This writ petition is disposed of with a direction upon the Controller of Examination, Burdwan University, respondent no.

to consider the representation dated June 17, 2022 within a period of one month from the date of communication of this order and pass a reasoned order. The reasoned order should be communicated to the petitioner within one week thereafter.

WPA No. 11594 of 2022 is disposed of.
