We are informed by the learned advocate, Mr.

Soumik Mondal, that there is no instruction from the client.

It is pointed out by the learned advocate for the respondents from the order of the Hon'ble Single Judge that the Court merely directed the District Magistrate to conclude the proceeding arising out of alleged erection of transformer on the subject premises.

Since, there is no instruction as regards development in this regard and the order of the Court is dated 23.05.2022, pendency of the appeal would be futile and serve no useful purpose.

The appeal is dismissed.
