Mr. Uttiya Ray Mr. Ashutosh Pal ... for the petitioners The petitioner has prayed for waiver of the eligible amount of the investment loan in terms of the Agricultural Debt Waiver and Debt Relief Scheme, 2008. The petitioner claims to have submitted a representation before the authorities of Birbhum Cooperative Agricultural and Rural Development Bank Ltd. on 18.04.2009.
The grievance of the petitioner is that till date no decision on such representation has been communicated to the petitioner till date. It has also been submitted by the learned counsel appearing for the petitioner that no further steps pursuant to the notice annexed as annexure P-3 to the writ petition has been taken as yet. In the light of the aforesaid submission, WPA 9380 of 2009 disposed of by giving liberty to the petitioner to submit a fresh representation before the authorities of the Birbhum Cooperative Agricultural and Rural Development Bank Ltd. and if such representation is submitted, the competent authorities of the said Cooperative Bank shall take a decision upon giving an opportunity of hearing to the
petitioner or his authorized representative and communicate such reasoned order to the writ petitioner immediately thereafter. The entire process shall be completed as expeditiously as possible but positively within a period of 8 weeks from the date of receipt of the server copy of this order alongwith the representation to be submitted by this order.
It is further made clear that this Court has not gone into the merits of the claim made by the petitioner and the authorities will be free to decide the same in accordance with law.
In the result, the writ petition stands disposed of with the aforesaid observations however without any order as to costs.
Urgent certified photostat copy of this order, if applied for, shall be given to the parties as expeditiously as possible on compliance of all necessary formalities. (Hiranmay Bhattacharyya, J.)
