Debashis Maity v. The State Of West Bengal And ORS.
17.05.2024 Ct. no.654 Sl. No.4 ss
IN THE HIGH COURT AT CALCUTTA
CONSTITUTIONAL WRIT JURISDICTION (Appellate Side) W.P.A. 13279 of 2024 Debashis Maity Vs.
State of West Bengal & ors.
Mr. Ujjal Ray Mr. Arpa Chakraborty ... for the petitioner Mr. Suman Sengupta Ms. Amrita Panja Moulick ... for the State Affidavit of service filed on behalf of the petitioner is taken on record.
Mr. Ujjal Ray, learned Advocate for the petitioner submits that the petitioner was an applicant in respect of vacancy notification dated 17th October, 2022. The petitioner was called for interview on 13th March, 2023 and 15th May, 2023. Accordingly, the petitioner appeared on the date fixed. However, the authorities thereafter have not taken any step and have kept the application for engagement of petitioner as FPS dealer pending. Hence, this writ petition.
Ms. Amrita Panja Moulick, learned Advocate for the State-respondents submits that there were two applicants, both of whom were found ineligible in respect of the subject vacancy. She files a copy of the letter dated
7th May, 2024 of the Sub-Divisional Controller, Food & Supply, Kharagpur, which is taken on record.
Learned advocate for State-respondents undertakes to hand over copy of the letter dated 7th May, 2024 to the learned Advocate for the petitioner.
As per letter under memo No.339(2)/SCF&S/KGP/ 2024 dated 7th May, 2024 it is found that the petitioner's application was rejected since he was found ineligible for the subject vacancy. Thus the contention of the petitioner that his application has been kept pending does not hold good.
In the aforesaid backdrop, the writ petition WPA 13279 of 2024 stands disposed of.
All connected applications, if any, stand disposed of.
There will be, however, no order as to costs. Interim order, if any, stands vacated.
All concerned parties shall act in terms of the copy of the order duly downloaded from the official website of this Court.
Urgent photostat copy of this order, if applied for, be given to the parties upon compliance of necessary legal formalities.
