Learned advocate appearing for the petitioners submits that the petitioners are in custody for 1 year 9 months and they are the driver and helper of the vehicle from where allegedly prosecution claims to have recovered 7828 bottles of Phensedyl. It has been contended that till date three witnesses have been examined and the seizure list witnesses did not support the prosecution case. Further prosecution intends to examine 14 witnesses in order to prove its case.
Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that videography is available which would also be placed before the Trial Court, if situation so calls for.
I have taken into account the quantum of seizure in the present case. Having considered the same, six months'
more time is granted to the prosecution to examine vital and relevant witnesses of the present case.
At this stage, the prayer for bail of the petitioners is rejected.
Petitioner will renew his prayer for bail after the aforesaid time period is over.
The application for bail, being CRM (NDPS) 1219 of 2026, is, thus, disposed of.
All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
