1. Having perused the averments made in the application for condonation of delay under Section 5 of the Limitation Act and being satisfied, delay in preferring the application being CRAN 4 of 2023 is condoned.

2. The application for condonation of delay being CRAN 3 of 2023 is allowed.

3. Having heard the learned Counsels appearing for the respective parties and after perusing the averment made in the application, I find that sufficient cause exists for recalling the order dated 17.10.2023 in CRAN 2 of 2023.

4. Accordingly, the order dated 17.10.2023 is recalled and CRAN 2 of 2023 is restored to its original file and number.

5. The application for restoration being CRAN 4 of 2023 is, thus, allowed.

6. Let the matter appear for further hearing three weeks hence (24.01.2024).

7. Learned Counsel for the State is directed to submit report on the adjourned date.
