The present petitioners are booked with an offence of abetment of commission of suicide by a victim boy.

Learned counsel for the petitioners submits that there was a broken relationship between the deceased boy and the present petitioner no.1 who belongs to a different religion. Accordingly, there are dispute between the family members of the parties. Hence, the boy has committed suicide. Learned counsel for the petitioners prayed for anticipatory bail on any condition.

Learned counsel appearing for the State has placed the suicidal note along with the photographs of the victim boy and the petitioner no.1 and other materials in the C.D.

Having heard the learned counsel for the parties and considering the materials in the C.D., it appears that in respect of the petitioner no.1, investigation is going on, to unearth the truth. Custodial interrogation of the petitioner no.1 is required.

Accordingly, prayer for anticipatory bail in respect of petitioner no.1 is considered and rejected.

Prayer for anticipatory bail in respect of the petitioner nos.2 and 3, who are, prima facie, not directly involved, is considered and allowed.

Accordingly, It is directed that in the event of arrest, the petitioner nos.2 and 3 be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten thousand only) each, with two registered sureties of like amount each, subject to the satisfaction of the learned ACJM at Barrackpore, North 24 Parganas on condition that the petitioners must appear before the Investigating Officer once in a week until further order and shall also comply with the provisions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. 8.

Return the C.D. immediately.
