Learned advocate appearing for the petitioner is aggrieved by the fact that the rooms of his hotel have been locked in the year 2020. There are padlocks still existing for which the petitioner is unable to run his hotel.

report dated 13.08.2024 has been submitted by the learned advocate appearing for the State. Let the same be kept with the record. The said report reflects that earlier also a General Diary vide Kakdwip PS GDE No. 1175 dated 26.06.2021 was submitted by the present petitioner viz. Krishna Prasad Jana. The hotel was examined and found to be closed and the petitioner could not be contacted by SI Mridul Kanti Barua of Kakdwip Police Station. Having considered the report, I am of the view that Kakdwip Police Station has no objection, if the hotel is operated by the present petitioner.

The petitioner apprehends that there may be breach of peace. If the situation so arises, the police authorities would render assistance, otherwise from

the report it do not reflect that any case is pending for which the hotel has been closed at the instance of any government authority. It would be the liberty of the petitioner to open and operate the hotel. Subsequently, if there is any local disturbances, the petitioner would be at liberty to approach the police authorities and the police authorities will act in accordance with law.

With the aforesaid observations, the writ petition being WPA 12850 of 2021 is disposed of. Pending connected application, if any, is consequently disposed of.

There shall be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
