Protim Chakraborty, learned advocate, empanelled with the office of the Government Pleader, High Court, Calcutta, is directed to represent the State. His appointment may be regularised by the concerned authorities.

Learned advocate for the petitioner is directed to hand over a copy of the writ petition to learned advocate for the State.

The petitioners have approached this Court as they could not enjoy peaceful possession in respect of the property which they claim of their own.

Learned advocate appearing for the respondent nos. 7 and 8 disputes the contention of the petitioners and submits that a civil suit is pending which is disputed by Mr. Manna, learned advocate appearing for the petitioners.

Having regard to the fact that last of the information was furnished in the year 2023, I am of the view that if a civil suit is pending, the

petitioners will approach the civil court for appropriate remedies.

The police authorities would ensure that no breach of the peace or tranquility takes place at the locale and/or any untoward incident results because of the strained relationship existing between the petitioners and the private respondents.

With the aforesaid observations, the writ petition being WPA 12299 of 2023 is disposed of. There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
