After hearing the learned advocates appearing for the parties, we are of the view that the writ petitioners ought to have availed of the alternative efficacious remedy available to them under the West Bengal Estate Acquisition Act, 1953 by preferring an appeal before the appropriate authority.

In the event, an appeal is filed, as stated above, within thirty days from date, the appropriate authority shall dispose of the said appeal as expeditiously as possible without granting any unnecessary adjournment to either of the parties and without insisting for an application under Section 5 of the Limitation Act, by passing a reasoned order.

The writ application is, thus, disposed of without, however, any order as to costs.

The appellate authority shall act on the electronic copy of this order to be communicated to him.
