Mr. Siddhartha Banerjee Ms. Soni Ojha Ms. Sambrita B. Chatterjee ...for the petitioner 11.06.2025 (AD 37) (S. Banerjee) On the prayer of the learned advocate appearing for the petitioner, leave is granted to the learned advocate-on-record of the petitioner to amend the prayer portion of the application here and now. Mr. Banerjee, learned advocate appearing for the petitioner submits that the hearing of the application under Order 12 Rule 6 of the Civil Procedure Code has been fixed in the month of November, 2025. He further submits that the said application is otherwise ready for hearing.

In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate-on-record of the petitioner shall be obliged to forward a copy of this application along with this order, upon the opposite parties or upon the learned advocate representing the opposite parties before the learned trial judge.

After some argument, Mr. Banerjee, learned advocate appearing for the petitioner prays for a liberty to approach the learned trial judge for preponing the date of hearing of such application. In the light of the submission made by Mr.

Banerjee, CO 1938 of 2025 stands disposed of by giving liberty to the petitioner to make an application before the learned trial judge for preponing the date of hearing of the application under Order 12 Rule 6 of the Code. If such an application is filed, the learned Civil Judge (Sr. Division), 1st Court at Barasat is requested to consider the same in accordance with law.
