Anam ... for the Petitioner Ld. advocate for the petitioner submits that he was not granted any opportunity to address the Court at the time when the charge sheet was submitted before the ld. CJM, Malda.

Primarily, I do not find any circumstance relating to the grievance arising in respect of the charge-sheet submitted.

However, the ld. advocate for the petitioner intends to file an application under section 173(8) of the cr.p.c. The petitioner would be at liberty to exhaust such remedy under the provisions of the statute and the ld. Magistrate would consider the same in accordance with law. With the aforesaid observations, CRR 1879 of 2023 is disposed of.
