06.07.2023 sdas rejected C.R.M.(NDPS) No. 1036 of 2023 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Jalangi Police Station Case No. 328 of 2022 dated 21.10.2022 under Sections 20(b)(ii)(c )/29 of the NDPS Act.

And In Re : Aslam Hossain & Ors. .... petitioners Ms. Chandrima Debnath ....for the petitioners Mr. Rudradipta Nandy, learned APP Mr. Subrato Roy ...... for the State Chemical examiner's report is placed on record. Report shows presence of Ganja in the sample. Materials on record prima facie establish recovery of 31.986 Kgs. of Ganja from the possession of the petitioners. Under such circumstances and in view of statutory restrictions under Section 37 of the NDPS Act, we are not inclined to grant bail to the petitioners.

The application for bail is, thus, rejected.
