The petitioner has renewed his prayer for bail. The records of the case reflect that the petitioner was arrested in April, 2023 and, since then, he is in custody. Ld. advocate for the petitioner submits that earlier there was a direction passed by this court to renew the prayer for bail after the evidence of the victim is over. Ld. advocate submits that since the petitioner is in custody for a considerable period of time and the evidence of the victim is over, he may be released on bail on any stringent condition.

Mr. Mukherjee, ld. advocate for the State, opposes the prayer for bail. He draws the attention of the court to the medical report.

I have considered the statement of the victim as well as her evidence including the medical reports and, on an assessment of the same, I am of the view that further detention of the petitioner may not be warranted in the facts and circumstances of the case.

Hence, the prayer for bail of the petitioner is Allowed.

Accordingly, the petitioner viz, Ranjit Halder shall be released on bail upon furnishing bond of Rs.10,000/-(Rupees Ten Thousand only), with two sureties of like amount each, one of whom must be local, to the satisfaction of the Ld. Special Court, Malda/ld. CJM, Malda.

If on bail, the petitioner shall be physically present on each and every date so fixed by the ld. trial court and will not leave the district of Malda without the permission of the ld. Special Court, Malda.

Accordingly, CRM(SB) 58 of 2024 is allowed.

Pending application(s), if any, is also disposed of. Case Diary be returned to the ld. advocate for the State.
