The petitioner seeks bail.

Learned Advocate appearing for the petitioner submits that the petitioner is in custody for over three years and eight months. The petitioner was not identified in the T.I. Parade. Only a sum of Rs.1,000/- was shown to be recovered from the possession of the petitioner which is claimed to be the motive of the dacoity. He submits that the petitioner was falsely implicated.

Learned Advocate for the State draws attention of the Court to the seizure list and various statements recorded under Section 161 of the Code of Criminal Procedure, 1973. He submits that the trial commenced and five witnesses were examined.

Considering the gravity of the offence and the complicity of the petitioner in the alleged incident and the fact that the trial

commenced, we are not in a position to grant bail to the petitioner.

Accordingly, the prayer for bail being C.R.M. 5405 of 2021 is rejected.
