Ray, Mr. Partha Sarathi Pal ...for Respondent Nos. 2, 3, & 4 By filing this writ petition, the petitioner has 05-12-2024 AKG Ct. 15 impugned the order dated November 17, 2023, passed by the Joint Registrar of Cooperative Societies, Kolkata Metropolitan Area Housing Cell.
It appears that the petitioner harbors grievances regarding the affairs of the Janantik Co-operative Housing Society Ltd., of which he is a member. The society had allotted a flat to the petitioner. A dispute subsequently arose concerning the completion of the flat, which was eventually decided by the Joint Registrar of Cooperative Societies, Kolkata Metropolitan Area Housing Cell, by the order dated November 17, 2023.
The present writ petition concerns the legality and validity of this order.
In view of the stance taken by the parties before this Court, it is not necessary to decide the propriety of the order dated November 17, 2023.
It is an undisputed fact that a sum of Rs.
5,22,400/- is currently held by the cooperative society, which was deposited by the petitioner for the completion of his flat. The society has agreed to refund this amount to the petitioner within seven days from the date of this order.
The petitioner has also agreed to complete the construction of his flat within a period of eight months following the receipt of the aforementioned amount from the cooperative society.
In light of the foregoing, no further orders are necessary in this writ petition. The society is, however, further directed to provide an account of the expenditure of Rs. 4,94,775/- paid by the petitioner to the society up to the year 2007.
With the aforesaid observation, WPA 13325 of 2024 is disposed of.
