Shahi Ms. Susmita Chatterjee .... For the State The petitioner alleges that she is restrained by the private respondents from cultivating her own land. She lodged complaint before the police authority on 28th March, 2025 which has not been acted upon.

It appears from the report submitted by the State that pursuant to the complaint lodged by the petitioner enquiry was held and prosecution submitted under Section 126 of the BNSS. The private respondents appear to be co-owners of the land in question. Since the allegation of the petitioner is that the private respondents are restraining her from cultivating her portion of the land, she is at liberty to approach the appropriate forum for redressal of her grievance. In the meantime, the police authority shall keep strict vigil in order to avoid any untoward incident in view of the strained relationship between the parties and shall also ensure maintenance of peace and tranquility.

The writ petition is accordingly disposed of. There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
